Terms of Business

These Terms of Business (“Terms”) govern access to and use of the ApprenticePath platform (“Platform”).


The Platform is operated by ApprenticePath (ABN 70 294 898 832) of 202/50 Brunker Road, Broadmeadow NSW 2292 (“ApprenticePath”, “we”, “us”, “our”).


By accessing or using the Platform, you agree to these Terms.


1. Definitions

  • Platform means the ApprenticePath software application and related services.
  • Employer means the organisation that creates and manages an account.
  • User means any person accessing the Platform, including Employers, Supervisors, Apprentices, Trainers (RTO representatives), and Parents/Guardians.
  • RTO means a Registered Training Organisation.
  • Content means any data, images, records, or information uploaded to the Platform.


2. Acceptance and Capacity

By using the Platform, you confirm that:

  • You have authority to accept these Terms; and
  • If you are acting on behalf of an Employer, you bind that Employer.

Employers are responsible for all Users they invite or authorise.


3. Nature of the Platform (No Reliance)

The Platform is a recording, communication, and visibility tool only.

To the maximum extent permitted by law:

  • The Platform does not provide training, assessment, legal, employment, or compliance advice.
  • Any insights, prompts, alerts, or summaries are informational only.
  • Users must not rely on the Platform as a substitute for professional advice, employer obligations and/or RTO responsibilities.

ApprenticePath makes no representation that use of the Platform will:

  • Ensure apprenticeship completion
  • Ensure regulatory compliance
  • Improve employment outcomes


4. User Roles and Responsibilities

4.1 Employer

The Employer:

  • Is the primary account holder
  • Controls access for all Users
  • Is responsible for: Accuracy of all data entered, supervisory and employment obligations and compliance with applicable laws


4.2 Supervisors, Trainers, and Other Users

Users must:

  • Provide accurate information
  • Use the Platform lawfully
  • Not upload misleading or inappropriate content


4.3 Apprentices

Apprentices:

  • Must ensure accuracy of submitted work logs and evidence
  • Acknowledge that entries do not constitute formal assessment


4.4 Parents/Guardians

Where an Apprentice is under 18:

  • A Parent/Guardian may be invited with the Apprentice’s consent
  • Visibility is limited to information made available by the Employer


5. RTO and Third-Party Disclaimer

ApprenticePath:

  • Is not a Registered Training Organisation (RTO)
  • Does not deliver or assess training
  • Is not responsible for competency outcomes, training delivery or certification decisions

All RTOs are independent entities.


6. Data and Privacy

ApprenticePath collects and uses personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This includes:

  • Personal details
  • Employment and training data
  • Uploaded evidence (including images)
  • Data relating to minors

By using the Platform:

  • Employers warrant they have authority to upload personal information
  • Users consent to collection and use of their information

A separate Privacy Policy applies.


7. User Content

  • Users retain ownership of their Content
  • Users grant ApprenticePath a non-exclusive, worldwide, royalty-free licence to Host, Store, Display and Process Content

Users warrant that:

  • They have the right to upload Content
  • Content does not breach any law or third-party rights


8. Intellectual Property

All rights in the Platform, including:

  • Software
  • Design
  • Branding
  • Functionality

are owned by ApprenticePath.

Users must not:

  • Copy, modify, reverse engineer, or reproduce the Platform
  • Use the Platform for competitive purposes


9. Fees and Future Pricing

The Platform is currently provided free of charge.

ApprenticePath reserves the right to:

  • Introduce fees in the future
  • Provide notice prior to any charges


10. Service Availability


ApprenticePath does not guarantee:

  • Continuous availability
  • Error-free operation

The Platform may be:

  • Updated
  • Modified
  • Suspended

at any time without notice.


11. Limitation of Liability

To the maximum extent permitted by law:

ApprenticePath is not liable for:

  • Indirect or consequential loss
  • Loss of profits, revenue, or business
  • Loss of data
  • Employment or training outcomes

Where liability cannot be excluded:

  • It is limited to: 1. Re-supply of the services; or 2. $100 AUD

Nothing in these Terms excludes rights under the Australian Consumer Law.


12. Indemnity

Users and Employers indemnify and hold harmless ApprenticePath against any claim, loss, or damage arising from:

  • Use of the Platform
  • Breach of these Terms
  • Inaccurate or misleading data
  • Employment, supervision, or training decisions
  • Content uploaded to the Platform


13. Termination

ApprenticePath may:

  • Suspend or terminate access at any time

Employers may:

  • Cease use at any time

Upon termination:

  • Access may be revoked
  • Data may be deleted


14. Changes to the Platform

ApprenticePath may:

  • Add, remove, or modify features
  • Introduce new functionality

No guarantee is provided that:

  • Current features will remain available


15. Assignment

ApprenticePath may assign or transfer its rights and obligations to:

  • A related entity
  • A future incorporated company

Users consent to such assignment.


16. Governing Law

These Terms are governed by the laws of New South Wales, Australia.


17. General

If any provision is invalid, the remainder continues.

These Terms constitute the entire agreement.
